You will be working as a Constructions Contracts Specialist and will be the part of Process Automation Business Area for Energy Industries Division based in Cairo, Egypt. In this role you will be reporting to the Project Operations Manager and will be responsible for ensuring all contract management activities are tendered, negotiated and executed in accordance with the contract negotiations handbook/contract management framework and relevant Group/Division/Business Unit directives and instructions, including company procedures and the contract management framework.

Your responsibilities

Tender preparation and negotiation support: Reviewing and commenting on contract terms and conditions and annexes to the contract/frame agreement. Defining contract management strategy and contract formulation. Supporting bid go/no-go decisions based on risk assessment of contract terms and conditions.

Contract execution (from project kick-off to project closure): Identifying the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract) and highlights areas of potential risk. Giving guidance on general contractual issues, clarifying queries if required by referring to legal department.

Contract closure: Verifying that both parties to the contract have fulfilled their contractual obligations and there are no responsibilities outstanding. Assessing success of the contract and determines if there are any lessons learned for future contracting. Documenting and communicating to all appropriate parties any deficiencies found as part of the closeout process.

Contract and claims: Enforcing and defending ABB’s contractual interests towards customers and suppliers, including monitoring and assessment of changes and deviations, as well as defending and enforcing claims. Supporting legal handling formal dispute resolution, litigation and arbitration, notifying and liaising with legal to report major claims and keeping legal updated of any critical development during project execution.

Commercial execution: Ensuring timely and accurate execution of commercial aspects of contracts (payments, claims, variation orders, warranties, provisions, bank credits, etc.) and assisting the Project manager or sales manager or FES manager in initiating guarantees when creating the contract.

Risk management: Analyzing prime contract terms to highlight areas of potential opportunity and risk, such as ambiguities, omissions and conflicts, as work proceeds. Seeking advice from legal to draft, negotiate and finalize agreements during the sales and project execution phases. Developing and implementing risk mitigation and opportunity plan in concert with project manager or sales manager or FES manager.

Insurance: Ensuring contract insurance provisions are adhered to and coordinates with insurance risk management personnel regarding occurrences that may be covered by customer or ABB provided insurance.

Purchasing: Supporting drafting of purchase orders, contracts and subcontracts and ensuring that relevant (sub) contracts contain appropriate contract terms to protect ABB’s interest, including flow-down of main contract terms.

Export controls: Seeking advice from legal (export control) to ensure accurate handling of all export control matters with regard to restrictions on exports, considering countries, customers or products involved and the respective laws and ABB regulations.

Job Specification

Your background

Bachelor’s degree in engineering.

Minimum 7-10 years of experience in contract management for construction projects.

Should be open to work in temporary position for the period of 18 to 24 months.

Ability to think in an analytical form especially when planning or encountering a problem.

Required computer skills in Microsoft office (mainly excel, Word, and power point).

Fluency in both spoken and written English & Arabic language is a must.
